Refund, Cancellation and Access Policy
Last updated: 31 August 2026
This Refund, Cancellation and Access Policy applies to purchases made from TutorMe Stellenbosch (“we”, “us” or “our”) through tutor-me-stellenbosch.co.za.
1. Our digital educational content
We provide digital educational content, including pre-recorded tutoring and instructional video lessons.
Unless otherwise stated on the relevant product page, successful payment grants the purchaser a personal, limited and non-transferable right to access the purchased content for a period of four (4) months from the date of purchase.
Access is ordinarily made available electronically as soon as reasonably possible after successful payment.
The purchase is not an automatically renewing subscription and no further payment will automatically be charged when the four-month access period ends.
2. Four-month access period
Subject to applicable South African law, access to the purchased content ends four (4) months after the date of purchase.
The purchaser is responsible for making use of the content during this period. A failure to view, complete or make use of some or all of the content during the four-month access period does not, by itself, create an entitlement to an extension, cancellation or refund.
Where any provision of the Consumer Protection Act 68 of 2008 relating to fixed-term agreements applies to a particular transaction, the purchaser will retain all rights granted by that Act and we will comply with any applicable statutory requirements relating to cancellation, expiry and renewal.
3. Immediate commencement of access
At checkout, the purchaser is requested to expressly consent to access to the purchased digital educational content commencing immediately after successful payment.
Where section 42(2)(d) of the Electronic Communications and Transactions Act 25 of 2002 applies because a service has begun with the consumer's consent before the end of the applicable seven-day period, the cooling-off right in section 44 of that Act does not apply to that service.
Nothing in this Policy is intended to exclude any cooling-off or cancellation right that remains applicable under South African law.
4. Change-of-mind refunds
Except where a refund, cancellation or other remedy is required by applicable law, we do not ordinarily provide refunds simply because a purchaser:
- changes their mind after purchasing;
- decides that they no longer require the content;
- purchases the incorrect course, subject or grade;
- does not have sufficient time to use the content;
- fails to use or complete the content within the four-month access period;
- does not achieve a desired academic result; or
- decides after obtaining access that the content does not meet their personal expectations, provided that the content supplied materially corresponds with the description made available before purchase.
Purchasers should therefore carefully review the course description, subject, grade, curriculum and other relevant information before completing payment.
Nothing in this section applies where the content was materially misrepresented, defective or otherwise gives rise to a statutory remedy.
5. Returns and exchanges
Because the products supplied are digital content and access rights, they cannot ordinarily be physically returned once access has been provided.
We therefore do not ordinarily offer voluntary returns or exchanges after access has commenced.
This does not limit any right to return, replace, cancel or obtain another remedy where such a right arises under applicable South African law.
6. Statutory cooling-off and cancellation rights
Nothing in this Policy limits any right that a consumer may have under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, or any other applicable South African law.
Where section 44 of the Electronic Communications and Transactions Act applies, a consumer may have a statutory right to cancel an electronic transaction for services within seven days after conclusion of the agreement, subject to the exclusions contained in that Act.
Where a transaction results from direct marketing and section 16 of the Consumer Protection Act applies, the consumer may exercise the cooling-off right provided by that section within the period prescribed by law.
Where section 14 of the Consumer Protection Act applies to a fixed-term consumer agreement, a consumer may exercise the cancellation rights provided by that section. Any amount retained, refunded, credited or charged following such a cancellation will be determined in accordance with the Act and applicable regulations, including any reasonable cancellation penalty permitted by law.
7. Defective content, material errors or failure to provide access
If:
- we fail to provide the access that was purchased;
- a material technical problem attributable to us prevents reasonable access to the purchased content;
- the content supplied materially differs from the description presented before purchase; or
- the goods or services fail to meet a standard required by applicable consumer legislation,
the purchaser should contact us at statistics224tutor@gmail.com as soon as reasonably possible.
We may investigate the issue and request information reasonably necessary to identify the transaction and understand the problem.
Where applicable law gives the purchaser a choice of remedies, that statutory choice will not be restricted by this Policy.
Depending on the circumstances and the applicable legislation, a remedy may include correcting the problem, replacement or restoration of access, a reasonable partial refund, a full refund, or another remedy required by law.
8. Academic outcomes
Our educational content is intended to assist learning but, unless we have expressly stated otherwise in writing, we do not guarantee any particular examination mark, school result, academic improvement, university admission or other educational outcome.
Failure to achieve a desired academic result does not, by itself, establish that the purchased content was defective or entitle the purchaser to a refund.
This section does not excuse any false, misleading or materially inaccurate representation made by us about the content.
9. Prepaid amounts and future access
Where applicable South African law treats any portion of an amount paid to us as money held for future services or future access rather than as our property immediately upon payment, we will account for and deal with that amount as required by law.
Nothing in this Policy permits us to retain an amount that applicable law requires to be credited or refunded to a purchaser.
10. Duplicate and incorrect charges
If a purchaser is charged more than once for the same transaction as the result of a verified payment-processing error, the duplicate charge will be refunded.
Suspected unauthorised transactions should be reported to us promptly and, where appropriate, to the purchaser's bank or payment provider.
11. Requesting a cancellation or refund
To request a cancellation, refund or other remedy, please contact:
Email: statistics224tutor@gmail.com
Business name: TutorMe Stellenbosch
To help us identify and process the request, please provide where available:
- the purchaser's full name;
- the email address used for the purchase;
- the order or transaction number;
- the date of purchase; and
- a brief explanation of the request.
We may request further information reasonably necessary to verify the transaction.
Failure to provide information that is not legally required will not invalidate a statutory cancellation or refund right, and requests for additional information will not extend any statutory refund deadline.
12. Refunds
Where we voluntarily approve a refund, or where a refund is required by law, it will ordinarily be returned using the original payment method where reasonably practicable.
Where legislation specifies a period within which a refund must be made, the refund will be processed within that statutory period.
13. Consumer rights prevail
This Policy must be read and interpreted subject to applicable South African law.
Nothing in this Policy is intended to waive, exclude, restrict or deprive a consumer of a right that may not lawfully be waived, excluded or restricted.
If any provision of this Policy conflicts with a mandatory provision of applicable consumer legislation, that legislation will prevail and the remainder of this Policy will continue to apply to the fullest extent permitted by law.
